These Terms of Use(“Terms“) apply to your access to, and use of, any service offered by DaleeloCommunity Network (hereinafter referred to as “Daleelo.org Services“), including Masajid, Trip Planner, Charity Section and Business or other onlineproducts or services provided by Daleelo.org (collectively, the “Services“). Thefollowing terms and conditions (the “Terms”) apply to our provision and youruse of the Daleelo Community Network, services and materials (“the services”)through the Daleelo Community Network website and mobile applications below.

These services make upthe Daleelo Community Network Services. If you are using any of these Services on behalf of any entity, you represent and warrant that you are authorized to accept these Terms on such entity’s behalf, and that such entity will beresponsible to Daleelo Community Network if you violate these Terms

2.     Scope

You may use our Services only if you can form a binding contract with Daleelo Community Network, and only in compliance with these Terms and all applicable laws. When you create your Daleelo Community Network account, and subsequently when you use certain features, you must provide us with accurate and complete information,and you agree to update your information to keep it accurate and complete. Any use or access by anyone under the age of 13 is prohibited, and certain regionsand Content Offerings may have additional requirements and/or restrictions.

3.     Disclaimer Exclusions and Limitations

Please note that your access and use of the website and App is subjected to your responsibility. However, We employ modern and secure techniques to protect our systems fromintrusion by unauthorized individuals, and we regularly upgrade our security asbetter methods become available, while we do this, please note that no securitysystem is impenetrable and due to the inherent nature of the internet, wecannot guarantee that data, during transmission through the internet or while stored on our systems or otherwise in our care, is absolutely safe fromintrusion by others it is the sole responsibility of the user to stay safe within the platform. Daleelo.org will not be held responsible for any type ofloss or damage which you may sustain as a result of accessing and using the Application. Daleelo.org assumes no responsibility for the contents of anyother website to which the App may have links, and if you access any suchlinked sites, and fail to read their terms of service and Privacy Policy, you do so at your own risk. Daleelo.org’ inclusion of links to such website and Apps does not imply any endorsement by Daleelo.org of the materials on suchsites.

Your use of the Daleelo.org.comApp is at your own discretion and subject to all applicable national andinternational laws and regulations. Daleelo.org Reserves the right to modify,supplement, move or delete portions of or add to the site at any time with orwithout notice

4.     Service Order Terms

Your purchase of any digitalservice through the Site is subject to the terms and conditions stated on theapplicable order form(s) and the applicable terms stated in these Terms. Allprices are subject to change.

5.     Description of Services

Daleelo.org is a Geoservice-based platform company based in Texas where local families can provide services for local communities. Daleelo.org also operates a platform that help consumers find great localbusinesses that are Muslim-friendly, as well as provide other services tailored for the Muslim community. We also provide a donor platform for charity where donors will donate to a particular campaign, however we will receive anon-refundable percentage of the donations.

We also have an iPhone app and android application as well as a website. Below are our various type of services provided by Daleelo.org

6.     Daleelo Donations and Community Project Services

The Daleelo.org Servicesare offered as a platform to allow an individual, entity or non-profitorganization (the "Campaign Organizer") to post a fundraisingcampaign ("Campaign") to the Daleelo Donations and Community project Platform to accept monetary donations ("Donations") from donors("Donors").

The Daleelo CommunityNetwork Services provide a donation platform which allows Campaign Organizer to accept Donations from Donors for a charitable purpose. This means that, in connection with Daleelo Community Network, either the Campaign Organizer or Beneficiary must be a non-profit organization and established as such under the applicable laws of incorporation (“Charities”). For example, in the United States, the Campaign Organizer for Daleelo Community Network Services must be a non-profitorganization, raising funds for a charitable purpose.

7.     Your Agreement with us

This Site is controlled and operated by Daleelo.org(“Daleelo.org”) from its offices within the United States. Daleelo.org makes no representation that materials in the Site are appropriate or available for use in other locations, and access to them from territories where its contents areillegal, is prohibited. Those who choose to access this site from locations outside the United States are responsible for compliance with all applicable laws.

8.     No Solicitation

The Daleelo.org Platforms (collectively“Platforms”) are offered to help Campaign Organizers raise money. Daleelo.org merely provides the technology to allow fundraisers to connect with Donors. Theexistence of the Services is not a solicitation of donations by Daleelo.org,and Daleelo.org does not engage in any solicitation activities, or consult on the solicitation of contributions from the public, on behalf of any individual,entity, or organization. By using the Services, you understand and agree that Daleelo.org shall not be responsible for the use of your donations or the amount of fundsraised for the User, Campaign, or event.

9.     Donors

All Donations are at your sole discretion. When you donate through either of the Platforms, you understand that Daleelo.org will receives a commission for every donation provided onthe Daleelo.org Platform. Daleelo.org is not responsible for any offers,promises, rewards or promotions made or offered by Users or Campaigns. We donot and cannot verify the information that Users or Campaigns supply, nor do werepresent or guarantee that the Donations will be used in accordance with anyfundraising purpose prescribed by a User or Campaign or in accordance withapplicable laws. Notwithstanding the foregoing, we take possible fraudulent activity and the misuse of funds raised very seriously. If you have reason to believe that a User or Campaign is not raising or using the funds for their stated purpose, please email us at support@daleelo.org to alert our team ofthis potential issue and we will investigate.

  • Donors are not permittedto impose restrictions on the use of Donations by a Charity or Event Organizer.To the extent that a Donation is made in response to an appeal for a particularprogram of a Charity or Event Organizer, or to the extent that a Donor purportsto direct the use of Donations by a Charity or Event Organizer, any suchdirections shall constitute non-binding recommendations only and the Charity or Event Organizer shall have full discretion to determine how all Donations willbe used.
  • Daleelo.org makes norepresentation as to whether all or any portion of your Donations, including,if any, Daleelo.org commissions, Payment Processor Fees, are tax deductible oreligible for tax credits. Daleelo.org will have no liability for any claim by any federal, state, provincial, territorial, local or any other tax authoritywith respect to the characterization on any applicable tax return of any Donation by you, any User or any Charity. You should consult your tax advisoras to the amount of your Donation that is tax deductible or eligible for taxrecognition, having regard to (among other things) the tax status of the recipient of any Donation in any relevant jurisdiction, and particularly if youare awarded a gift or prize in connection with your Donation.
  • Donors shall provide Daleelo.org with such information as is required to enable the issuing of an official Donation receipt. Donor acknowledges and agrees that, in accordance with thePrivacy Policy, certain Donor’s personal information will be shared with the Charity to which such Donor makes a donation and may be used by such Charity inaccordance with the Charity’s Privacy Policy. Daleelo.org is not responsible,and shall not be liable, for any Charity’s use of any Donor information.

Certain states require written disclosures for Charities soliciting contributions. For donors making donations to Charities, please see the state non-profit disclosures for those charities.

10.  Campaign Organizer

You, as a Campaign Organizer, represent, warrant,and agree that (i) all information you provide in connection with a Campaign or Beneficiary is accurate, complete, and not likely to deceive reasonable Users;(ii) all Donations contributed to your Campaign will be used solely asdescribed in the materials that you post or otherwise provide; (iii) if you withdraw donations believed by reasonable Donors to be raised on behalf ofsomeone other than you (i.e., the Beneficiary), all Donations will be given toand/or spent on behalf of the Beneficiary; (iv) if you add a Beneficiary through the Services, you relinquish control of the Donations, including theability to issue refunds; (v) you will not infringe the rights of others; (vi)you will comply with all relevant and applicable law and financial reportingobligations, including but not limited to laws and regulations relating toregistration, tax reporting, political contributions, and asset disclosures for your project; and (vii) to the extent you share with us any personal data ofany third party for any purpose, including the names, email addresses and phonenumbers of your personal contacts, you have the authority (including anynecessary consents), as required under applicable law, to provide us with such personal data and allow us to use such personal data for the purposes for whichyou shared it with us. Campaign Organizers will comply with all applicable lawsand regulations, including laws and regulations from the jurisdictions fromwhich a Campaign Organizer solicits donations. Campaign Organizers that sharepersonal data with us further represent and warrant that they may share suchpersonal data with us under applicable law without restriction. You authorize Daleelo.org,to charge you a commission for every donation, and Daleelo.org reserves the right to, provide information relating to your Campaign to Donors,beneficiaries of your Campaign or law enforcement, and to assist in any investigation thereof.

If you use the Services as an agent of a Charityusing the services to raise funds for such Charity, you represent and warrantthat: (a) you are a representative of the Charity, which representative isauthorized to raise funds or bind the Charity to these Terms of Service; (b)you are raising funds for a Charity, with a cause or activity that is legalunder all applicable federal, state, provincial, territorial and local laws andregulations; (c) all donated funds will be used solely for the purpose you havestated on and in connection with your Campaign, and under no circumstances may you use the funds for any other purpose; (d) your Charity has and will maintaintax-exempt status under applicable law.

11.  Daleelo.org Commission, Campaign Owners and Donated Funds

As a Campaign owner using the Daleelo.org platform, you agree to receive donated funds in 2 ways. These methods arespecified in confidential agreements (Service Agreements) disclosed with Campaign Owners. In order to place your project on the Daleelo.org platform you must agree to the service agreement.

12.  Items/ Services (If Applicable)

Specific Items services may be availableexclusively online through our website and App. These Items or services may belimited and are subject to refund or cancellation only according to our RefundPolicy.  We have made every effort todisplay as accurately as possible the services and items that appear on the website and App. We cannot guarantee that your computer monitor’s display willbe accurate.

We reserve the right but are not obligated, tolimit the sales of our items or Services to any person, geographic region, orjurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the number of any services that we offer. All descriptionsof Items/services pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any listing orquotation at any time. Any offer for any product or service made on this site is void where prohibited.

13.  Advertising Package

Daleelo provides advertisements and promotions packages for Business Owners. Business Owners agree that any advertisements posted orlisted on the Daleelo.org site must relate to their services in accordance withthe relevant categories available on the advertising platform. Setting up advertisements that relate to service provision (e.g. personal benefits) isexpressly prohibited.

By using the Sites, you agree that Daleelo hasthe right charge you an advertising fee to run such advertisements and promotions on the Sites. The manner, mode, and extent of advertising by Daleeloare subject to change. The Business Owners correspondence or business dealingswith, or participation in promotions of, advertisers found on or through theSites.

14. Privacy and Data Protection

Our Privacy policy explains how we treat your personal data. By using the Services, you agree to our privacy policies and that we can use your information in accordance withour privacy policies. By using and benefitting from Daleelo.org’ Services you recognize that personalization lies at the core of many of our services. We canonly provide many of these Services by using your personal data to provide personalized content and ads. Please visit our Privacy policy to learn more about personalization.

15. Applicability

These terms and conditions apply to every user or user that place an order on the Daleelo.org web site. Prior to the conclusion of a transaction or order, the text of these general terms and conditions will be made available to the user.

16. Service Providers

By registering or usingthe Site as a service provider to offer, post or provide a service, youre present and warrant that they, and the employees, agents, contractors, and subcontractors who may perform work for you, are properly and fully qualified and experienced, and licensed, certified, bonded, and insured, as required byapplicable laws or regulations and in relation to the specific job they areperforming. Service Providers understand and agree that sending a quote doesnot guarantee the quote will be read and using the Site does not guarantee theywill be hired for work.

You will not use, copy,adapt, modify, prepare derivative works based upon, distribute, license, sell,transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Site or Content, except as expressly permitted in these Terms. The Site and Content are provided to you AS IS. If you download or print a copy of Content for personal use, you must retain all copyright and other proprietarynotices contained thereon. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned orcontrolled by Daleelo Community Network or its licensors, except for thelicenses and rights expressly granted in these Terms.

In posting or submitting material about your Business on the Site, you warrant that - All such materialis not private and is intended for publication on the Site; You grant the Website the unrestricted right to use, reproduce, modify, translate and distribute any material you post or submit to the Site in any medium and forany purpose, including commercial uses; All such material is truthful andaccurate to the best of your knowledge; You will not use obscene or offensive language or submit any material that is, or may potentially be, defamatory,abusive or hateful, an invasion of anyone's privacy, harmful to other users,harmful to the business interests of the Website, or encourages conduct thatwould constitute a criminal offence, give rise to civil liability, or otherwiseviolate any local, national or international law or regulation.

You agree not to post,or, to encourage or procure others to post Comments and/or Ratings about your Business on the Site, which is untrue, inaccurate or misleading. You agree notto disclose your login details to third parties. If you do so, you are liablefor any breach of these Terms and Conditions by third parties using your login detailsand the indemnity referred to in these terms is extended accordingly.

17.  Eligibility

You must be at least 13 years of age to access or use our Services. If you are accessing or using ourServices on behalf of another person or entity, you represent that you are authorized to accept these Terms on that person or entity’s behalf and that the person or entity agrees to be responsible to us if you or the other person or entity violates these Terms.

18. Online service Terms

By agreeing to theseTerms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site. You may not use our servicefor any illegal or unauthorized purpose nor may you, in the use of the Service,violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

19. Account Registration

In order to use the Services, you must create an account (“Account”) with Daleelo.org. We provide 2 types of account, User account and Business Account. By registering with Daleelo.org for an Account, you give us some of your privacy data, such as:

  • Name in full
  • Email Address
  • Payment information etc.

And other information,needed for us to supply you with our Products and Services. You may read how we process, secure, and use your privacy data in our Privacy Policy and Cookie Policy page. You may be provided with a range of subscription options, andprices, for Registration, as listed on the subscription page of the Site

You agree to provide ustrue, accurate, current, and complete information when registering for an Account and will update the information as necessary to keep your Account and payment information current. As part of the registration process, you will provide Daleelo.org with a username and password for your Account (together “AccountCredentials”). Daleelo.org reserves the right to refuse registration of, or cancel, accounts it deems inappropriate.

You must be a human too pen an account. Accounts registered by “bots” or other automated methods are not permitted.

20. Account Security.

You are responsible for maintaining the security of your Account Credentials and for all Services ordered, accessed, or otherwise used in connection with your Account and all actions taken in association therewith. You will not share your Account Credentials with any third party.

21. Subscription / Service Fees / Payments

Daleelo Community Networkcharges certain amounts ("Daleelo Community Network Charges" or"Charges") for listing a business or donating on the website or Application. Current Charges related to the quoting process will be shown inyour ("Account "). Charges for additional services will be shown in policies or terms provided to you before you use such services. You agree to pay all applicable charges based on the Charge and billing terms in effect.

There are no fees forcreating an account on the Site. Campaign Owners are charged a Platform Fee asa portion of the Contributions they raise. In addition, Campaign Owners are charged a monthly charge by merchant service provider, gateway free, transaction fees by the payment processor. Transfer fees, or bank delivery fees, may also be applied each time Daleelo Community Network sends funds to a Campaign Owners’bank account. The Platform Fees and transfer fees/bank deliver fees are non-refundable and are effective on the date that they are posted and will be announced on the Platform Fee page.

In case of a dispute,however, we shall try and intervene only if the Client notifies us of the dispute in a time span of three days (3) after the day in which the payment wasmade.

22. VAT or Tax

Daleelo.org may collect VAT or other indirect taxes at the applicable rate for the country, as per applicable tax rules, at the time of purchase of Daleelo.org products or at thetime you use the Daleelo.org website and mobile application

23. Payment Options

If Your Purchased one ofour advertising packages (“advertising Services”), or perhaps you made a donation to one of the campaigns found here in, you agree that Daleelo.org will collect a non-refundable percentage/commission from the transaction. You agree to pay us all such fees when due. These fees may include advertising fees, Donorcommission, and tax, the prices, and terms of which are listed on our website and mobile application. If you have any complaints or dispute with your donated funds to campaign owners, please see our donated funds and refunds section for guidelines.

24. Payment Processor

Payments made on the Daleelo.orgwebsite and platform are not collected by us but through our designated payment gateway provider. You will be providing credit or debit card information directly to them who operate a secure server to process payment details,encrypting your credit/debit card information, and authorizing payment. The information which you supply to our payment provider is not within our control and is subject to their privacy policy and terms and conditions.

As a condition for Daleelo.org providing payment processing services through our designated Payment Processor,you agree to provide us accurate and complete information about you and any Campaigns, and you grant our payment processor the right to this information and transaction information related to your use of the Daleelo.org services.

Daleelo.org is notresponsible for the performance of our payment processor, you do not provide Daleelo.org your billing information but to our payment processor.

25. User Restrictions.

This is an agreement for Services, and you are not granted a license to any software by these Terms. Youwill not, directly or indirectly: reverse engineer, decompile, disassemble, orotherwise attempt to discover the source code, object code, or underlyingstructure, ideas, or algorithms of or included in the Services or any software,documentation or data related to the Services (“Software”); modify, translateor create derivative works based on the Services or any Software; or copy(except for archival purposes), distribute, pledge, assign or otherwise transferor encumber rights to the Services or any Software; use the Services or any Software for timesharing or service bureau purposes or otherwise for the benefit of a third party; or remove any proprietary notices or labels.

26. Service Amendments

If the User wishes torequest the provision of certain additional services which fall outside of the scope of the Services, it shall submit details of the requested additional services in writing to Daleelo.org. The Parties shall then negotiate in goodfaith the terms which are to apply to such additional services (including anyadditional fees and expenses) and shall document any agreed additional services in writing. Following which, such additional services shall be deemed to form part of the “Services”. For the avoidance of doubt, Daleelo.org shall be under no obligation to agree to the provision of any additional services.

27. Privacy Policy

Our Privacy Policy provides information regarding how we collect, use, and disclose your personal information. By creating an account, choosing a subscription plan, making a purchase,or otherwise using the Services, you acknowledge that we will collect, use and disclose your personal information as described in our Privacy Policy

28. Mobile Devices Terms

If you're accessing DaleeloCommunity Network Services from a mobile device using a Daleelo CommunityNetwork Mobile Application (the "Application"), the following termsand conditions ("Terms of Use") apply to you in addition to the applicable Mobile Privacy and Legal Notice or End User License Agreement, as the case may be. Your use of the Application confirms your agreement to these Terms of Use.

29. Application Use

Daleelo Community Network grants you the right to use the Application only for your personal use. Youmust comply with all applicable laws and third-party terms of agreement whenusing the Application (e.g. your wireless data service agreement). Your download and use of the Application is at your own discretion, sometimes, youmight experience a slow in device functions, and other computer or device malfunction; the Daleelo Community Network application might not be cause ofthese. Please endeavor to use an up to date device that can carry all functions of the Daleelo Community Network Application.

30. Rules of Conduct

Daleelo Community Network has the right, but not the obligation, to investigate any illegal orunauthorized use of the Services and appropriate legal action may be taken,including without limitation, civil, and injunctive relief. While utilizing the Services, you may not:

  • Post on the Services any links to any external Internet sites that are obscene or pornographic, or display pornographic or sexually explicit Material of any kind.
  • Post on the Services or transmit through the Services any Material that violates or infringes another person’s intellectual property rights (including, but not limited to, third party music, videos, photos or other materials where you do not have written authority from the owner to post or transmit such documents);
  • Post or transmit any Material that contains any advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes” or any other form of solicitation;
  • Reformat, frame or mirror any portion of any web page that is part of the service;
  • Post Material containing restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
  • Post or do anything that could disable, overburden, or impair the proper working of the Services;
  • Submit any Material that impersonates a person or entity, falsely implies sponsorship or endorsement of that Material by the Services, Daleelo Community Network and/or any third party, falsify or delete any author attributions in any Material, or promote any information that you know is false or misleading;
  • Transmit any viruses, worms, defects, Trojan horses or other items of a contaminating or destructive nature through the Services or otherwise attempt to interfere with the proper working of the service or the use and enjoyment of the Services by other users;
  • Post any trade secrets or other confidential information, or post any material that you do not have a right to make available under any law or under contractual or fiduciary relationships, including but not limited to inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements;
  • Without limiting the foregoing, Campaign Organizers represent and warrant that (1) all information provided in connection with a Campaign is accurate, complete, and not otherwise designed to mislead, defraud, or deceive any Member or other user; (2) all donations contributed to a Campaign Organizer’s Campaign will be used solely as described in the Campaign; and
  • Promote an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or videos or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
  • Submit Material, or engage in any activity, that is libelous, defamatory, obscene, pornographic, abusive, harassing, threatening, unlawful, or violates the rights of any third party (including their rights of privacy or publicity) or that promotes or encourages illegal activity, racism, bigotry, hatred, physical harm or discrimination of any kind against any group or individual; or
  • Post User Content that harasses, abuses, or threatens any other person, or that contains obscene content; is false, misleading, or inaccurate; degrades others on the basis of gender, race, class, ethnicity, national origin, religion, sexual preference, disability or any other classification; is unlawful, harmful, tortious, defamatory, libelous, or invasive of another's privacy;

Daleelo.org retains all right, title and interest in the platform, the Platform performance, including response times, load averages, usage statistics, and activity logs, (collectively, “Usage Information”) Usage Information, and any derivative works thereof. You will not copy or transmit any of the material except if you are doing so for your personal, non-commercial use. All copyright, trademark and other proprietary rights notices presented on our website and mobile application must appear on all copies you print. Other non-Daleelo.orgproduct, service, or Daleelo.org designations on our website and mobile application belong to those respective third parties and may be mentioned in our website and mobile application for identification purposes only. You should contact the appropriate vendor (store owners) for more complete information regarding such information and their product description. Your use of and access to our website and mobile application does not grant you any license orright to use any of the marks included on our website and mobile application.

33.  Public Posting and Forums

The Service may include various public forum, chat rooms, community pages, comments or chat features,or other forums (“Forums”) where you can post User Content, including, but notlimited to, your observations and comments on designated topics and on others’User Content. Daleelo.org cannot guarantee that other Users will not use theideas and information that you share. Therefore, if you have an idea orinformation that you would like to keep confidential and/or do not want othersto use, do not post it publicly on the Service. The Site, methods andprocesses may be covered by one or more patents or other intellectual property rights and are subject to trade secret and other proprietary rights. Daleelo.org reserves all such rights.

  1. Prohibited Use

The Services may include interactive areas where you or other users can create, post or store content,messages, materials, data, information, text, music, sound, photos, videos,graphics, applications, code or other items or materials on the Services(collectively, “User Content”). You are solely responsible for your use of such interactive areas and agree that you use them at your own risk. You further agree not to post, upload to, transmit, distribute, store, create or other wisepublish through the Services any of the following:

  • User Content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;
  • Loss or misuse of the login details and/or abuse of the Platform must be reported to Daleelo.org immediately. Daleelo.org is not liable for (the consequences of) loss of login details and/or the misuse of login details of the Customer by a third party.
  • Daleelo.org will always save all files, and documents created through our platform as long as a user pay their subscription fee.
  • Should a user wish to stop paying for the premium feature, perhaps wish to delete their Daleelo.org account or unsubscribe, the user must delete their documents, or else Daleelo.org will delete all of their data and documents after 3 months.
  • User Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law
  • User Content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party. By posting any User Content, you represent and warrant that you have the lawful right to distribute and reproduce such User Content;
  • User Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;
  • The user is obliged to keep his own current (digital) copy of all information, data and Content that the user provides to Daleelo.org under the terms of the execution of the Agreement, whether or not via the Platform
  • Daleelo.org will not compensate anyone if their files are lost due to technical problems or miss-use of their user account. The user must ensure to save copies of their documents on their computer, after every session.
  • Unsolicited promotions, political campaigning, advertising or solicitations;
  • Viruses, corrupted data or other harmful, disruptive or destructive files; and
  • User Content that, in the sole judgment of Daleelo.org, is objectionable or which restricts or inhibits any other person from using or enjoying the Services, or which may expose Daleelo.org or our users to any harm or liability of any type.
  • The use of the Platform by the user and Content he uploads and downloads, may not infringe the rights, good name and interests of Daleelo.org and/or third parties, including but not limited to intellectual property rights and rights relating to the protection of personal data.
  • The Content uploaded by the user must be provided in a manner and in a format as indicated by Daleelo.org.
  • The Content uploaded by the user is owned and remains the property of the user.

Except as otherwise provided herein, on the Services or in a separate agreement (such as the rulesof a Daleelo.org promotion), Daleelo.org claims no ownership or control over any User Content. However, by submitting or posting User Content to the Services, you grant Daleelo.org a nonexclusive, royalty-free, perpetual,irrevocable and fully sublicensable right to use, reproduce, modify, adapt,publish, translate, create derivative works from, distribute, perform and display such User Content on the Services and on third-party sites. You represent and warrantthat (a) you own and control all of the rights to the User Content thatyou post or you otherwise have the right to post such User Content to the Services; (b) the User Content is accurate and not misleading; and(c) use and posting of the User Content you supply does not violate theseTerms and will not violate any rights of or cause injury to any person orentity

39. Cancellation Policy.

Users have a right tocancel an already placed order for Advertising Packages, but this can only bepossible if the cancellation request was made within (12) hour after placingthe order. Only a (12) hour notice via e-mail or phone call will be acceptable meansof cancellation; any other means will not be accepted. Cancellation Requestsare subject to confirmation in writing.

40. Donated Funds Refund Policy

Without limiting anyother Daleelo.org rights, Daleelo.org will not issue a refund, reimburse,cover, or otherwise be responsible for any fees, including without limitationthose not paid to Daleelo.org.

41. Advertising Refund Policy

Because of the nature ofour business and the advertising subscription packages provided by Daleelo.org.All purchases for the Daleelo.org Advertising subscriptions are final. Asubscription can only be cancelled if Daleelo.org is given a 1 week noticebefore the next monthly subscription charge. The Site may rely on theusage of certain open source libraries and utilities from time to time. You are registering or using the Services constitutes your acknowledgement of havingread and understood the terms of the open source libraries.   2. The User declares and guarantees that he is authorized to provide and process the personal data as referred to in this terms to Daleelo.org with respect to the performance of the agreement.
  3. The User retains, as far as applicable, the title to the personal data provided to Daleelo.org.
  4. The User fully indemnifies Daleelo.org against all third-party claims, which arise in any way from and/or are related to the processing of personal data by Daleelo.org via the Platform and/or the Services, or by the third party providing services to Daleelo.org in this respect

53.  Service Amendment

Daleelo.org reserves theright to modify or discontinue, temporarily or permanently, the Services, orany features or portions thereof, without prior notice. You agree that Daleelo.org will not be liable for any modification, suspension or discontinuance of the Services, or any part thereof.

Youand Daleelo.org agree that any dispute arising out of or related to these Termsor our Services is personal to you and Daleelo.org and that any dispute will beresolved solely through individual action, and will not be brought as a classarbitration, class action or any other type of representative proceeding.

61.  Arbitration of Disputes

Exceptfor small claims disputes in which you or Daleelo.org seeks to bring an individual action in small claims court located in the county of your billing address or disputes in which you or Daleelo.org seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and Daleelo.org waive your rights to a jury trial and to have any dispute arisingout of or related to these Terms or our Services resolved in court. Instead,for any dispute or claim that you have against Daleelo.org or relating in anyway to the Services, you agree to first contact Daleelo.org and attempt toresolve the claim informally by sending a written notice of your claim(“Notice”) to Daleelo.org.co by email at support@daleelo.org The Noticemust

  • Include your name, residence address, email address, and telephone number;
  • Describe the nature and basis of the claim; and
  • Set forth the specific relief sought.

Our notice to you will be similar in form to that described above. If you and Daleelo.org cannot reach an agreement to resolve the claim within thirty (30) days aftersuch Notice is received, then either party may submit the dispute to binding arbitration administered by JAMS or, under the limited circumstances set forth above, in court. All disputes submitted to JAMS will be resolved throughconfidential, binding arbitration before one arbitrator. In accordance with the JAMS Streamlined Arbitration Rules and Procedures (“JAMS Rules”). The mostrecent version of the JAMS Rules is available on the JAMS blog site and arehereby incorporated by reference. You either acknowledge or agree that you haveread and understand the JAMS Rules or waive your opportunity to read the JAMSRules and waive any claim that the JAMS Rules are unfair or should not applyfor any reason.

You and Daleelo.org agree that these Terms affect interstate commerce and that theenforceability of this Section will be substantively and procedurally governedby the Federal Arbitration Act, 9 U.S.C. § 1, et seq. (the “FAA”), to the maximum extent permitted by applicable law. As limited by the FAA, these Termsand the JAMS Rules, the arbitrator will have exclusive authority to make all procedural and substantive decisions regarding any dispute and to grant anyremedy that would otherwise be available in court, including the power todetermine the question of arbitrability. The arbitrator may conduct only anindividual arbitration and may not consolidate more than one individual’s claims, preside over any type of class or representative proceeding or presideover any proceeding involving more than one individual.

The arbitrator, Daleelo.org, and you will maintain the confidentiality of anyarbitration proceedings, judgments and awards, including, but not limited to,all information gathered, prepared and presented for purposes of the arbitration or related to the dispute(s) therein. The arbitrator will have the authority to make appropriate rulings to safeguard confidentiality, unless the law provides to the contrary. The duty of confidentiality does not apply to the extent that disclosure is necessary to prepare for or conduct the arbitration hearing on the merits, in connection with a court application for a preliminary remedy or in connection with a judicial challenge to an arbitration award orits enforcement, or to the extent that disclosure is otherwise required by lawor judicial decision.

Any claim arising out ofor related to these Terms or our Services must be filed within one year after such claim arose; otherwise, the claim is permanently barred, which means that you and Daleelo.org will not have the right to assert the claim.

You have the right toopt out of binding arbitration within 30 days of the date you first acceptedthe terms of this agreement by sending an email to support@daleelo.org In order to be effective, the opt-out notice must include your full name and address andclearly indicate your intent to opt out of binding arbitration. By opting out of binding arbitration, you are agreeing to resolve disputes in accordance withthis agreement.

Ifany portion of this Section is found to be unenforceable or unlawful for anyreason, (a) the unenforceable or unlawful provision shall be severed from these Terms; (b) severance of the unenforceable or unlawful provision shall have noimpact whatsoever on the remainder of this terms or the parties’ ability to compel arbitration of any remaining claims on an individual basis pursuant to this terms; and (c) to the extent that any claims must therefore proceed on aclass, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration,and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration. Further, if any part ofthis terms is found to prohibit an individual claim seeking public injunctive relief, that provision will have no effect to the extent such relief is allowedto be sought out of arbitration, and the remainder of this terms will been forceable.

62.  Governing Law and Jurisdiction

This terms and conditions shall be governed and construed in all respects by the laws of the United States of America and Texas Supreme Court and the European Union GDPR regulation. You agree that any claim or dispute you may have against must be resolved by arbitration. You and Daleelo.org both agree to submit to the non-exclusive jurisdiction of the United States of America and Texas Supreme Court; for claims falling within Dallas Texas jurisdiction, you and Daleelo.org both agree to submit to the jurisdiction of the United States of America and Texas Supreme Court.

Any dispute arising from these Terms and your use of the Services will be subject to Arbitration,without regards to conflict of law rules or principles that would cause the application of the laws of any other jurisdiction. Any dispute between the parties that is not subject to arbitration or cannot be heard in small claims court, hence it will be resolved by arbitration.

63. Miscellaneous

Daleelo.org may modify the terms herein contained at any time. Such modifications shall be communicated by email and shall be binding on you. 

  • All disputes relating to these terms and any supplies made by Daleelo.org to you shall be governed by the laws of the United States of America without reference to its conflict of laws principles and is subject to the exclusive jurisdiction of the Texas Supreme Court.
  • Daleelo.org opinion on all issues pertaining to the interpretation of these Terms shall be final and binding on you.
  • Daleelo.org is subject to existing laws and legal process and nothing contained in these Terms is in derogation of Daleelo.org's right and obligation to comply with the Law or governmental, court and requests of enforcement agencies.
  • If any part of these terms are held to be invalid or unenforceable including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and is nevertheless valid and enforceable and the remainder of these terms shall continue in effect.
  • You may not assign any rights or obligations against Daleelo.org without Daleelo.org's prior written consent. Daleelo.org reserves the right to transfer any right or obligation against you upon notice to you. Upon such assignment, the assignee shall be bound by the Terms in the same manner as Daleelo.org and Daleelo.org shall cease to have any liability to you.

Daleelo.org shall not be responsible for any delay or deficiency due to any force majeure events such natural disasters, acts of terrorism, civil labor strife, labor and transportation strikes

64.  Termination

Daleelo.org reserves the right, without notice and in our sole discretion, to terminate your license to use the Services, and to block or prevent your future access to, and use of, the Services.

65.  Severability

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect thevalidity and enforceability of any remaining provisions.
